The State Board recently updated some of its forms to reflect updates to Board Rules. The changes this year were limited compared to last year, where many of the commonly-used forms were updated. One particular rule/form change that may be more likely to be at issue is Rule 226, which relates to conservatorships for minors or incompetent adults. The new rule raises the threshold for Board-appointed conservators from $50,000 to $100,000. This change allows settlements up to $100,000 involving conservators to remain out of probate court, which can delay settlement for several weeks while waiting for the probate court to appoint a conservator.
